A framework set by the CIMA Code

The only compensable losses are those listed in CIMA Code articles 258 to 266. The insurer and the victim have a window to negotiate an amicable settlement; failing agreement within that window, compensation is computed under articles 258 et seq.

The main heads of damage

Medical expenses (art. 258), temporary incapacity (art. 259), permanent disability (art. 260), third-party assistance (art. 261), pain and aesthetic damage (art. 262), career prejudice (art. 263). On death: funeral costs (art. 264), heirs' economic prejudice (art. 265) and heirs' moral prejudice (art. 266).

Estimating death compensation

Heirs' moral prejudice (art. 266) and funeral costs (art. 264) are set by the Code as multiples of the annual SMIG. Our calculator reproduces exactly these two heads; heads depending on the age-based capitalisation table are explained, not estimated.
